TERMS AND CONDITIONS OF USE

1. ACCEPTANCE OF TERMS

By accessing and using the JSKY SERVICES, INC. website (the "Website") provided by JSKY SERVICES ("JSKY"), you agree to be bound by these Terms and Conditions of Use (the "Terms") and JSKY's Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you are not authorized to use the Website.

JSKY reserves the right to modify these Terms at any time in its sole discretion. Your continued use of the Website after any such changes constitutes your acceptance of the new Terms. JSKY will make reasonable efforts to notify users of material changes to these Terms by posting a notice on the Website or sending an email to registered users.

2. DESCRIPTION OF SERVICES

The JSKY Website allows registered and unregistered users to upload, share, and view various types of digital content, including but not limited to photographs, videos, and text-based materials. The content on the Website may include sexually explicit adult content, as well as non-adult content.

JSKY may provide links to third-party websites, which are not owned or controlled by JSKY. JSKY assumes no responsibility for the content, privacy policies, or practices of any third-party websites. Users acknowledge that JSKY will not be liable for any issues arising from the use of such third-party websites.

The Website is for personal, non-commercial use only, except as expressly permitted under Section 16 of these Terms. Any illegal or unauthorized use of the Website is strictly prohibited, including but not limited to collecting usernames and email addresses for unsolicited emails or unauthorized framing or linking to the JSKY Website.

3. AGE REQUIREMENT AND ACCESS RESTRICTIONS

To use the JSKY Website, you must be at least eighteen (18) years of age or the age of majority in the jurisdiction from which you are accessing the Website, whichever is greater. If you are under the age of 18 or the age of majority in your jurisdiction, you are not permitted to use the JSKY Website.

JSKY reserves the right to implement age verification measures at any time to ensure compliance with this requirement. • 2. Depicts any person under the age of 18;
• 3. Infringes upon the intellectual property rights of any third party;
• 4. Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware;
• 5. Constitutes unauthorized or unsolicited advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;
• 6. Contains personal or identifying information about another person without that person's explicit consent;
• 7. Impersonates any person or entity, including any JSKY employees or representatives; or
• 8. Violates any applicable local, state, national, or international law or regulation.

JSKY reserves the right to monitor the Website and remove or terminate access to any content or user submissions that it deems, in its sole discretion, to be inappropriate, illegal, or in violation of these Terms, without prior notice.

5. CONTENT MONITORING AND ENFORCEMENT PROCEDURES

JSKY employs a multi-tiered approach to content monitoring and enforcement to maintain the integrity and safety of the Website:

• 1. Automated Screening: All user submissions are subject to automated screening using proprietary algorithms designed to detect potentially prohibited content, including but not limited to illegal material, copyright-protected content, and content depicting minors.
• 2. User Reporting: Users may report potentially violative content through the "Report Content" feature available on each content page. All user reports are reviewed by JSKY's content moderation team within 24-48 hours of submission.
• 3. Manual Review: JSKY maintains a dedicated content moderation team that conducts regular manual reviews of user submissions, with priority given to content flagged by automated systems or user reports.
• 4. Enforcement Actions: Upon determination that content violates these Terms, JSKY may take one or more of the following actions:
  • 1. Immediate removal of the violative content;
  • 2. Issuance of a warning to the user who submitted the content;
  • 3. Temporary suspension of the user's account;
  • 4. Permanent termination of the user's account;
  • 5. Reporting of illegal content to appropriate law enforcement authorities.
• 5. Appeal Process: Users whose content has been removed or whose accounts have been suspended or terminated may appeal such decisions by contacting JSKY's support team at support@jskyservices.com. Appeals will be reviewed within 5-7 business days, and decisions on appeals shall be final.
  JSKY reserves the right to modify these procedures at any time to improve the safety and integrity of the Website.

6. INTELLECTUAL PROPERTY

The content on the JSKY Website, excluding user submissions, is owned by and/or licensed to JSKY and is protected by copyright, trademark, and other intellectual property rights under both United States and foreign laws. Such content includes, but is not limited to, the JSKY logo, design elements, graphics, layout, text, software, audio, video, and other materials contained within the Website.

You may not use, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any of the content for any purpose without the prior written consent of JSKY or the respective owners. Nothing in these Terms shall be construed as conferring any license or right under any intellectual property right, whether by estoppel, implication, or otherwise.

You agree not to disable, circumvent, or interfere with any security-related features of the JSKY Website or features that prevent or restrict the use, copying, or distribution of the content.

7. USER SUBMISSIONS

JSKY permits the submission or upload of various types of digital content, including photographs, videos, and text-based materials (collectively, "User Submissions"). You shall be solely responsible for your User Submissions and their consequences.

You represent and warrant that you own or have the necessary rights, consents, and permissions to use and authorize JSKY to use all trademarks, copyrights, trade secrets, patents, or other proprietary rights in your User Submissions.

You further represent and warrant that your User Submissions do not depict any person under the age of 18 and that you have written documentation confirming that all subjects are over the age of 18.

By submitting User Submissions to the JSKY Website, you grant JSKY a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the JSKY Website and JSKY's business.

The foregoing licenses shall survive any termination of your account or these Terms.
